Terms of Service

These terms govern your use of AI Images Toolkit (the “Service”). By creating an account or using the Service you agree to them. If you don't agree, please don't use the Service.

1. The Service

AI Images Toolkit lets you generate images from text prompts, edit them in an online studio, and keep them in a personal library. Generation runs on third-party GPU runtimes, including free tiers of Google Colab and Kaggle.

Because of that, the Service is provided on a best-effort basis: it may be slow, unavailable, rate-limited or changed at any time, and we do not promise any particular uptime, speed or output quality.

2. Your account

  • You must be at least 13 years old to use the Service.
  • Provide accurate information and keep your password confidential.
  • You are responsible for activity under your account. Tell us promptly if you suspect misuse.

3. Acceptable use

You agree not to use the Service to:

  • Create, upload or share content that is illegal, or that sexually exploits or endangers minors.
  • Create content that harasses, threatens or defames others, or realistic imagery of real people without their consent in a way that could mislead or harm them.
  • Infringe anyone's intellectual property, privacy or other rights.
  • Attempt to disrupt, overload, probe or gain unauthorized access to the Service, its servers or the GPU runtimes behind it, or to bypass usage limits, including those of Google Colab and Kaggle.
  • Use automated means to submit large volumes of requests, or resell access to the Service.

We may remove content and suspend or terminate accounts that violate these rules.

4. Third-party services

If you connect a Kaggle account, you remain responsible for complying with Kaggle's terms, including any verification and usage limits, and you authorize us to use the credentials you provide solely to run your generations. Generation on Google Colab is subject to Google's terms. We are not affiliated with, or endorsed by, Google, Colab or Kaggle, and we are not responsible for their services.

5. Your content and AI output

You keep ownership of the prompts you write and, as between you and us, the images you generate and save, subject to the rights of others and applicable law. You give us a limited licence to host, store, process and display that content solely to operate the Service for you.

AI output may be inaccurate, unexpected or similar to output produced for other people, and the law around ownership of AI-generated images is still evolving. You are responsible for how you use what you generate and for making sure your use complies with the law.

6. Our rights

The Service, including its software, design and branding, is owned by us or our licensors and protected by intellectual property laws. These terms don't grant you any rights in them other than the right to use the Service as described here.

7. Suspension and termination

You can stop using the Service and delete your account at any time (contact us to have your data removed). We may suspend or end your access if you breach these terms, if required by law, or if we discontinue the Service. Sections that by their nature should survive termination will do so.

8. Disclaimers

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that your content will never be lost, so please keep your own copies of anything important.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the previous 12 months (which may be zero) or USD 50. Nothing in these terms limits liability that cannot be limited by law.

10. Changes to these terms

We may update these terms from time to time. We will change the “Last updated” date and, for significant changes, make a reasonable effort to let you know. Continuing to use the Service after changes take effect means you accept the new terms.

11. Governing law

These terms are governed by the laws of the jurisdiction in which the operator of the Service is based, without regard to conflict-of-law rules, and disputes will be handled in the courts of that jurisdiction, except where your local consumer law says otherwise.
